1. Scope of Application
These Terms and Conditions apply to all contracts concluded via our webshop www.cabanon.com between MANUFACTURE DES TENTES CABANON (hereinafter “Cabanon”, “we”, “us”) and customers located within the European Union and the United Kingdom.
These Terms apply to both consumers and business customers, unless otherwise stated.
2. Contract Conclusion
The presentation of products in our webshop does not constitute a legally binding offer. A binding contract is only formed once the order is explicitly accepted by Cabanon, either by confirmation email or shipment of the goods.
The order process consists of the following steps:
- Placing products in the shopping cart
- Entering personal and shipping data
- Choosing a payment method
- Final order confirmation
The order is binding after the customer clicks the “Order Now” button.
3. Prices & Payment
All prices listed are in EUR, inclusive of statutory VAT (for consumers and for business customers).
Payment is due immediately upon ordering and can be made via:
- Secure credit card payment
- Other options as offered in the checkout process
Cabanon reserves the right to refuse or cancel orders in the event of payment issues or price calculation errors.
4. Shipping & Delivery
Unless agreed otherwise, delivery is made to the address provided by the customer. Delivery times are indicated on the respective product pages and during the checkout process.
Delays due to force majeure (e.g. strikes, pandemics, raw material shortages) or default of payment do not entitle the customer to compensation or cancellation.
Goods are shipped at the customer’s risk once handed over to the carrier.
5. Retention of Title
Goods remain the property of Cabanon until full payment has been received. Business customers are not entitled to resale, transfer, or pledge the goods prior to full payment.
6. Right of Withdrawal (Consumers Only)
Consumers within the meaning of EU law have the right to withdraw from the contract within 14 days without giving any reason.

This right does not apply to business customers or for custom-made or clearly personalized tents.
7. Warranty & Complaints
Statutory warranty rights apply to all products. Complaints regarding defects or non-conformity must be submitted in writing within 8 days of receipt of the goods.
We reserve the right to either repair, replace, or refund the defective item.
Further claims are excluded, unless mandated by law.
8. Liability
We are only liable for damages caused by intent or gross negligence.
We do not accept liability for indirect damages, consequential losses, or lost profits.
This limitation does not apply in the case of personal injury or where liability is mandatory under consumer protection laws.
9. Jurisdiction and Applicable Law
The exclusive place of jurisdiction is Dunkerque, France, for all disputes arising from or in connection with the contractual relationship.
For consumers, this applies only if it does not restrict mandatory consumer protection rights in their country of residence.
French law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10. Final Provisions
If any provision of these Terms is or becomes invalid, the remainder shall remain unaffected.
Any changes to these Terms must be made in writing.
These Terms are available in English. In case of discrepancies between language versions, the English version shall prevail.
